Court Rules on Lead Paint ImmunityThe Lead Poisoning Prevention Program, first implemented in 1996, has resulted in a 98% reduction in the incidence of childhood lead poisoning. On October 24, 2011, Maryland's highest Court struck down important provisions of this program.
The Court ruled (a) Landlords are no longer immune from lawsuits when they comply with the Program and (b) Qualified Offers were determined to violate the Maryland Declaration of Rights. Many Landlords who, beginning in 1996, made an investment to bring properties into compliance relied on the State Law that limited their liability and made them immune from frivelous law suits. This Court decision is reason to evaluate one's exposure to the risk of law suits.
What to do? Join us and support the Property Owner's Association in working on a solution that preserves the rights of children while at the same time provides a market of affordable housing options in Baltimore and throughout the State of Maryland.
Lead Compliance: Dust Wipes Only Beginning Janaury 1, 2012Beginning January 1, 2012, Visual Inspection are no longer permitted. Inspectors now check for no chipping, flaking or peeling paint, and all "affected" rental units must pass a dust wipe test in order to receive a Certificate of Compliance with the Lead Poisoning Prevention Program.

Legislative IssuesLocal and State Governments continually propose new laws and regulations that affect rental property ownership, investment, and management. Property Owners Association of Greater Baltimore, Inc. promotes decent, affordable housing in the Greater Baltimore area. Legislation and regulation, though well-meaning and well-intended, often has the effect of increasing the cost of managing and owning rental property; costs that are ultimately passed on to those who can least afford it, residents of our rental properties. Each year usually sees over 1,500 new pieces of legislation proposed in the House of Delegates and over 1,000 bills introduced in the State Senate. You are encouraged to contribute to the POA Political Action Committee (PAC) so that we can raise money to lobby legislative representatives and administrative personnel to keep rental housing in Baltimore affordable. |
